We share this newsletter to keep you informed about the progress of the pending action and other developments of interest to you. AIRS is still in the process of gaining more registrants to strengthen its position in the court proceedings. Background to AIRS’ action

AIRS started legal proceedings against Airbus SE (“Airbus”) in April 2022 before the District Court of The Hague (the “Court”). In your interest AIRS aims to obtain compensation for the misconduct of Airbus.

Airbus facilitated large-scale corruption in its business and did not adequately inform you and other investors about the wrongful conduct. In the interest of investors AIRS is actively taking steps to recover the losses suffered. While research is ongoing, our economic expert (Fideres) in a preliminary assessment calculated that investor losses are significant. The compensation for individual investors will be determined at a later stage and the amount will depend on the (the timing of) trades effectuated.

AIRS works closely together with Airbus Investors Recovery Limited (“AIRL”). AIRL seeks compensation on behalf of approx. 200 institutional investors that have assigned their damages claims to AIRL. Together with AIRL, AIRS has reached out to authorities in the US and the UK to obtain further information on the misconduct to further strengthen the position of harmed investors.


Next steps

In our previous newsletter from December 2022, we informed you that the Court first wants to decide whether AIRS may to bring the claim on behalf of investors. Airbus has expressed its opposition in written statements filed in November 2022. AIRS has responded in writing in February 2023.

The next step is an oral hearing. The hearing will take place on 23 March 2023. AIRS is confident that it will be appointed the “Exclusive Representative” that may bring claims of harmed investors, including you. The decision from the Court is not expected before May 2023.
